Das Landgericht München I hat entschieden, dass die Raummiete für eine geplante, aber wegen der Corona-Maßnahmen abgesagte Hochzeit dennoch zu begleichen ist.

Geklagt hatte der Vermieter eines Schlosses auf Zahlung der vereinbarten Miete in Höhe von 7.363,04 Euro. Die ursprünglich für den 20. Juni 2020 vorgesehene Hochzeitsfeier konnte wegen der durch die 5. BayIfSMV auferlegten Kontaktbeschränkungen nicht durchgeführt werden. Der Kläger machte gleichwohl die Zahlung der mit Vertrag vereinbarten Miete geltend.Die Beklagten hatten gegen eine Zahlungsverpflichtung eingewandt, der Kläger habe seine Leistungsverpflichtung ebenfalls nicht erfüllt. Da die Räume für eine Hochzeit überlassen werden sollten hätte der Vertragszweck insgesamt nicht erreicht werden können, so dass beide Parteien…

I am so happy, my dear friend, so absorbed in the exquisite sense of mere tranquil existence, that I neglect my talents. I should be incapable of drawing a single stroke at the present moment; and yet I feel that I never was a greater artist than now.
